FOIA DUMP: Internal Memos and Documents related CVS’s and Nobscot Shopping Center/Centercorp’s Noncompliance to Framingham’s Planning Board Agreements and Decisions

THE REQUEST: Seeking all correspondence, email or otherwise, between Kevin Shea and anyone where either of the words/phrases exist, “CVS” and/or “Minute Clinic”.  Dates to seek 2/1/2021-5/18/2021.

THE RESPONSE: Hundreds of Pages of Documents (below) and this text: Economic Development/Planning and Community Development Department has attached all relevant documents in response to your request. Four of the emails responsive to your request have been partially redacted.  The emails include legal advice sought and received by various City officials from the Framingham City Solicitor’s Office, specifically Chris Petrini and/or Amanda Zuretti.  The legal advice reflected in the emails was sought and given in confidence, and the privilege to such advice has not been waived by the City.  Such portions of the emails are exempt from disclosure under the common law attorney-client privilege recognized in Suffolk Construction v. DCAM 449 Mass. 444 (2007).  The dates, the names of the author and recipient and the general subject of the privileged communications are set forth in the emails themselves. You have a right to appeal this response by filing an appeal with the Supervisor of Public Records or by filing an action in Superior Court.

As a FOIA Dump, there may be perceived duplication of documents. This is because e-mails, and forwards of emails are often included with one line changes.
