City’s License Board to be Hoodwinked tonight. State’s ABCC to be bamboozled today.

At 1:30 today Jan 23, 2023, Fashionable Concepts seeks an appeal with the state to overturn the Framingham License Board’s denial of renewal of alcohol retail sales license. If you remember, Fashionable Concepts competed against other local businesses for one last license. Fashionable Concepts was not actively in business at the time and was competing against brick and mortar convienance stores looking to expand their market.

Fashionable Concepts, as we now learn, while in the competition they had planned to open in the AutoZone/Papa Ginos/Cochituate Road plaza, that within 2 weeks of obataining the license they started trying to sell the license to the companies they competed against as well as to other corporations.

Fashionable Concepts never started converting the space they had supposedly leased to be a store.

Enter Fresh Market. They had already started converting the old Bed Bath & Beyond location on Worcester Road as of fall 2022, to be a new store, offering alcohol sales. Fashionable Concepts was to sell their free license that they obtained via the competition for free to Fresh Market for a profit of nearly $350,000.

Fresh Market and Fashionable Concepts appeared through counsel at a recent License Board meeting for this transfer of license, and the board not only denied them the transfer, after in the meeting they had learned that Fashionable Concepts within 2 weeks was peddling its license for sale, but in a subsequent meeting, denied the renewal of the license based on the non use of the license, equating it to an inactive license, so that when they sued or appealed the decision at the state or court level, that there would be no license to transfer going forward.

Today, Fashionable Concepts, will be appealing this matter to the ABCC, the state licensing board for alcoholic beverages. Immediately after the hearing where Fashionable Concepts expects to have their license reinstated – they head to the Framingham Board of License Commissioners, where they will propose a new location of their store at Hartford and Concord St, within a quarter mile to other licquor stores, in a small location with no parking….

We believe their goal is to keep their license alive by stating their intent to open at this location, to even open briefly as a basic packie – only to sell their license for a huge profit to Fresh Market within a few months.
